Disney waives arbitration in a $50,000 wrongful-death lawsuit filed by Jeffrey Piccolo after his wife died from an allergic reaction at Raglan Road Irish Pub in Disney Springs.
Bollywood Fever: Disney has decided to waive arbitration in a wrongful-death lawsuit filed by Jeffrey Piccolo, whose wife, Dr. Kanokporn Tangsuan, died after suffering an allergic reaction while dining at the Raglan Road Irish Pub in Disney Springs, Orlando, last year. The company had initially sought to have the case dismissed and resolved out of court, but it will now allow the matter to proceed in court.
The incident occurred in October 2022, when Tangsuan experienced a fatal allergic reaction after consuming food at Raglan Road, a restaurant tenant at Disney Springs that is not owned or operated by Disney. Piccolo is suing Disney for $50,000, alleging that despite informing the server multiple times about his wife’s food allergies, they were reassured that the food would be safe.
Disney initially argued that by signing up for a free trial of Disney+ in 2019 and later purchasing theme park tickets through his Disney+ account in 2023, Piccolo had agreed to Disney’s terms of service, which included a clause requiring all disputes with the company to be settled through arbitration rather than in court. However, Disney has now chosen to waive its right to arbitration.
“In such unique circumstances as the ones in this case, we believe this situation warrants a sensitive approach to expedite a resolution for the family who have experienced such a painful loss,” said Disney Experiences Chairman Josh D’Amaro in a statement. “As such, we’ve decided to waive our right to arbitration and have the matter proceed in court.”
Piccolo’s attorneys criticized Disney’s initial attempt to enforce the arbitration clause, calling it “outrageously unreasonable and unfair.” They argued that Disney was effectively trying to prevent its 150 million Disney+ subscribers from ever pursuing a wrongful death case against the company, even in situations unrelated to Disney+.
The legal proceedings will now continue in court, where the specifics of the case, including the family’s repeated warnings about Tangsuan’s food allergies, will be examined.
