Justin Timberlake‘s recent DWI arrest is being contested by his lawyer, who claims the singer was not intoxicated at the time of his arrest.
Timberlake’s attorney, Edward Burke Jr., argued in court that his client was wrongfully arrested, citing serious errors by the police despite their intentions. Justin, currently performing in Poland, did not attend the hearing.
Burke filed a motion to dismiss the case due to an accusatory instrument defect, arguing issues with the document formally accusing Timberlake of the crime. While the motion is under review, the case is unlikely to be dismissed outright. Timberlake’s arraignment, with new charging documents, is set for August 2, where he is expected to appear virtually.
The incident occurred in mid-June when Timberlake was pulled over by Sag Harbor Police for allegedly weaving on the road and running a stop sign after a night out with friends. Law enforcement sources stated that Timberlake performed poorly on field sobriety tests and refused a breathalyzer. Police noted signs of intoxication, including glassy eyes and the smell of alcohol, leading to his arrest and DWI charge.
Surveillance footage later showed Timberlake’s car before the traffic stop. Despite the charges, Timberlake, who has no plans for rehab, continues his tour and has even joked about the arrest during performances. Burke has stated that Timberlake is prepared to fight the charge vigorously.
