London, Bollywood Fever: A woman who caused the death of her 11-year-old neighbor with illegally imported poison gas has avoided jail time. Jesmin Akter, 34, imported aluminum phosphide from Italy to combat a bedbug infestation in her flat in Tower Hamlets, east London. Failing to read the packaging, she distributed a lethal amount of the substance and left her home with her family for 24 hours.

The aluminum phosphide reacted with moisture, creating phosphine gas, a compound comparable to chemical warfare agents. This toxic gas seeped into a neighboring flat, killing Fatiha Sabrin on her 11th birthday and hospitalizing another child on December 11, 2021.

Akter admitted to manslaughter by committing an unlawful act and importing a regulated substance. She was sentenced to two years in jail, suspended for two years, along with 150 hours of unpaid work. Old Bailey Judge Alexia Durran acknowledged the ongoing bedbug issue in Akter’s block of flats and the landlord’s insufficient pest control measures.

Judge Durran highlighted the potential danger Akter’s actions posed, stating that bringing aluminum phosphide on a passenger flight from Italy could have caused a catastrophic mid-air incident if the packaging had been damaged. Within a short period of distributing the tablets, other occupants, including children, began to feel unwell.

The court heard an emotional statement from Fatiha’s father, Mohammed Islam, who described his daughter as an “amazing, intelligent child.” Fatiha fell ill in the early hours of December 11 and was initially advised by paramedics to take diarrhea medication. Her condition worsened, and she died in the hospital later that day. The fire brigade identified the presence of the poison, leading to a hazardous materials incident.

Judge Durran expressed that no sentence could bring Fatiha back or fully satisfy her family. She noted Akter’s overwhelming guilt and acknowledged that Akter would likely never forget that her actions led to Fatiha’s death.

The court was told that Akter imported the aluminum phosphide from Italy without a license on November 26, 2021. Initially, she claimed she had bought the substance in a shop, but later admitted it was brought to Italy by her mother from Bangladesh. Prosecutor James Dawes KC revealed that the levels of phosphine gas in Fatiha’s home were significantly above the lethal dose, emphasizing the severe risk it posed, especially to children.

Firefighters discovered a grey powdery residue in Akter’s flat, and it was revealed that she had used nearly three times the recommended amount of the substance for commercial warehouses, despite it not being intended for use in dwellings.

Akter expressed deep remorse, stating she did not realize the danger her actions posed to her neighbors. In a handwritten statement, she explained that she used the “anti-bedbug” product out of desperation after failed extermination attempts by her landlord. She apologized to Fatiha’s family, acknowledging that they had “paid the price” for her actions.
