Drake’s touring company faces a trademark lawsuit from Members Only over T-shirts sold during his It’s All a Blur Tour, allegedly causing marketplace confusion.
Bollywood Fever: Drake‘s touring company, Away From Home Touring Inc., has been hit with a trademark infringement lawsuit by the iconic apparel brand Members Only. The lawsuit, filed on June 11 in New York federal court, claims that merchandise sold during Drake’s It’s All a Blur Tour infringed on Members Only trademarks.
According to court documents obtained by XXL, Members Only is not accusing Drake of selling counterfeit jackets but alleges that T-shirts sold during the tour prominently featured the phrase “Members Only” in large script, which the brand claims violates their trademark. JR Apparel World LLC, the current owner of the Members Only brand, stated that while the insignia refers to Drake’s song “Members Only” from his latest album For All the Dogs, this does not eliminate the likelihood of confusion or authorize Live Nation (which backed the tour) or Drake to use the trademark on apparel.
The lawsuit argues that the T-shirts are likely to confuse fans into thinking that the real Members Only brand is associated with the merchandise, causing marketplace confusion. JR Apparel claims that they tried to resolve the issue amicably with Away From Home Touring Inc. between April 3, 2024, and June 6, 2024, but were unsuccessful. They are now demanding the destruction of all infringing T-shirts in the company’s possession and a full accounting of all profits generated from their sale.
Drake has achieved remarkable success in the music industry, with a Billboard feature published on November 2, 2023, revealing him as the top-grossing hip-hop act of all time, earning $472.9 million from over 300 tour shows attended by 3.9 million fans. Last year, his It’s All a Blur Tour sold nearly 400,000 tickets and generated over $105 million in revenue.
