Prosecutors Seek Harsher Sentence for ‘Rust’ Armorer Hannah Gutierrez-Reed Amid Controversial Remarks.
Prosecutors are seeking an additional 18 months in jail for Hannah Gutierrez-Reed, the armorer on the film “Rust,” who faces sentencing today after being found guilty of involuntary manslaughter in the death of cinematographer Halyna Hutchins. Hutchins died in October 2021 during a rehearsal when a gun handled by actor Alec Baldwin discharged live ammunition, for which Gutierrez-Reed was responsible.
During the trial, which lasted two weeks, prosecutors argued that Gutierrez-Reed’s negligence in handling live ammunition on the “Rust” set, where it was explicitly banned, contributed to the tragedy. They also highlighted her failure to adhere to fundamental gun safety rules. The jury convicted her in March, and the charge carries a maximum sentence of 18 months and a $5,000 fine.
Prosecutors claim that Gutierrez-Reed, aged 26, has not expressed remorse for her role in the incident. Instead, in monitored jailhouse phone calls with her mother, boyfriend, and her attorney’s paralegal, she used derogatory language to describe the jury members, calling them ‘aholes,’ ‘idiots,’ and ‘r***s.’
Special prosecutors Kari Morrissey and Jason Lewis argued against granting Gutierrez-Reed a conditional discharge, urging the judge to impose the maximum penalty and classify her as a ‘serious violent offender’ to restrict any future sentence reduction.
In their legal filing, prosecutors also noted Gutierrez-Reed’s desire for Alec Baldwin, who was holding the gun when it fired, to be jailed, stating, “Hannah wants them to put Alec Baldwin in jail also.” They highlighted her refusal to testify in Baldwin’s upcoming trial under the pretext that “she shouldn’t be subpoenaed if Baldwin didn’t show up for her.”
Furthermore, Gutierrez-Reed’s actions post-conviction have also come under scrutiny. Prosecutors mentioned her attempts to persuade Hutchins’ widower and son to speak on her behalf at her sentencing and her frustration over the impact of the conviction on her life and possible modeling career. They emphasized her ongoing lack of genuine remorse and accusations against trial witnesses of lying.
Additionally, Gutierrez-Reed faces another felony charge related to concealing a firearm at a bar in New Mexico. According to the filing, she circumvented security, entered the restroom, and recorded a video stating, “They checked my purse but they didn’t check my butt cheeks! Wah, wah, wah.”
Inmate comments relayed by Gutierrez-Reed were also included in the filing, such as, “I can’t believe they threw your pretty little white a** in here for nothing,” and her complaints about the quality of prison food, likening it to cat food.
Her attorney, Jason Bowles, informed NBC News, “We will be filing a reply most likely tomorrow.”
Gutierrez-Reed was convicted by a jury in March and has been detained at a county jail outside Santa Fe for over a month. Alec Baldwin, also charged with involuntary manslaughter, has pleaded not guilty, asserting he did not pull the trigger when the gun discharged. His trial is set for July under the same judge, Mary Marlowe Sommer, who presided over Gutierrez-Reed’s trial.
